Assumption of Risk and Release of Liability

Activities May Include: Swimming, boating, waterskiing, wakeboarding, tubing, paddleboarding, kayaking, ATV riding, hiking, and general outdoor recreation.

1. Acknowledgment of Risks
I understand that participation in outdoor and water activities (including boating, waterskiing, wake boarding, tubing, foiling, e-foiling, power boarding, PWC [jet ski] riding, atv riding, and other activities) involve inherent risks, including but not limited to drowning, collisions, falls, injuries, sun exposure, and accidents caused by equipment failure, operator error or weather conditions. I voluntarily choose to participate (or allow my child to participate) in these activities with full knowledge of the dangers involved.
2. Assumption of Risk
I voluntarily assume full responsibility for any risks of loss, property damage, personal injury, or death that may be sustained by me or my child while participating in these activities or while on the premises.
3. Release and Waiver of Liability
In consideration of being allowed to participate in these activities, I hereby RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Sleepy Hollow Properties, LLC, Tegron Holdings, LLC, Chad Christensen, Kristin Christensen, their family, employees, volunteers, agents, and assigns (the Hosts) from any and all liability, claims, demands, actions, or causes of action for any damage or injury, including death, that may be sustained by me or my child, whether caused by the negligence of the Hosts or otherwise.
4. Medical Treatment Consent
I authorize the Hosts to provide or seek emergency medical care for me or my child if deemed necessary. I assume full responsibility for any costs related to such treatment.
5. Indemnification
I agree to INDEMNIFY AND HOLD HARMLESS the Hosts from any loss, liability, damage, or cost, including attorneys' fees, they may incur due to my participation or that of my child.
6. Severability
If any provision of this agreement is found to be invalid, the remaining provisions shall remain in full force and effect.
7. Electronic Signature Consent
By typing your name below, you agree that your electronic signature is the legal equivalent of your handwritten signature on this document. You consent to be legally bound by this agreement's terms and conditions. Your electronic signature, together with the date and time of signing, will be recorded and stored as part of this agreement in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law. You may withdraw this consent at any time prior to submission by closing this page. Once submitted, this agreement is binding.
